We've seen this happen a number of times. It's all too easy for the experienced con artist to "slip out" of any restraint they aren't pinned into. That's one reason why a lot of parks started getting rid of log flumes a few years ago IIRC. The only way you can fall out of one of these chairs is if you want to. I'm sure the park will fight this and not settle as it would just open the door for more of the same. I hope they have video evidence they can then use to counter-sue.

COASTER FREAK 11 Posted December 23, 2014 Posted December 23, 2014 I also feel like if this happened in the catastrophic way were all thinking, that we would have heard about a major injury at Dollywood. Also, there would be witnesses and the ride op in sure would have seen this.

I'm sure there's tons left to do elsewhere. Sorry I didn't snap any pics. It was packed last night, Tuesday. Mystery mine never opened, FCE wasn't running when we walked past it, so everything else had long lines. Around 7 or so the rest of the open coasters closed for cold temps., causing big lines in the Country Fair. I've never seen the bumper cars have a 30 minute wait before. Might be down for the rest of the season Didn't go down due to weather but due to mechanical problems

Much better written than all the tabloid sites that where publishing this news.. I can understand how it happened now.. Basically it says she undid her handlebar when the swing stop spinning.. Anyone being on this ride knows it still has to descend after that point. She lifted her bar to realize the swing was still descending and fell out A real news site does a much better job than tabloid sites!!! I for the life of me had no idea how anyone could fall out after reading this on the tabloid sites.. You don't open your safety devices for any reason until the operators tells you to. This is announced on both the loud speakers and the ride regulations in front of the line. If you don't have the ability to notice that you are 15 feet in the air before jumping out of your seat, you aren't smart enough to be an independent adult. Paradox Posted January 4, 2015 Posted January 4, 2015 Are they really trying to argue that the park failed to warn the riders that they shouldn't open their harnesses until the ride is on the ground? With that logic everyone should have jumped out at that point.

Hahaha I guess they want what skyscreamer has where the chain locks in place until the ride stops.. Either way I don't think anyone is entitled to a settlement for this so I hope Dollywood fights it!! BTW last time I was on those swings it only takes 4 or 5 seconds for them to lower! Just be patient people haha

The default is not "do whatever you want unless you're told not to"; it's "only do the things the operators tell you to do." I've ridden so many wave swingers--they're one of my favourite flats--and always, just ALWAYS, the ride ops have to tell people not to pull their bars up until the ride has actually stopped. It is truly pathetic that they have to do this, but they do have to ensure everyone's safety. It's just kind of sad that the biggest danger on this ride is the riders themselves. But I guess that's true of a lot of rides.

Sounds like a selling point for Mondial and their heavy "OTSR" Windseeker restraints. The woman who did this is seriously dumb, and her lawyer is just going after a defendant with deep pockets.
