I love how the article says, "It's not just about the failure to warn about the ride, but the failure to maintain the ride," said co-counsel George Dent. "The industry has ignored this risk and wants it to go away." I refuse to believe there are no warning sign outside Blazing Fury as there is with most coasters. Oh well, this will most likely end with another pointless park inspection and added restraints.

I mean come on, people are suing over the smallest things in this country just to get more money. And the wife is suing for 2 million because "for the loss of her husband's consortium and other "tangible benefits" including "love, affection, attention, caring and companionship." Now I personally believe that the 2 million one should be thrown out of court.
coaster1 Posted August 16, 2005 Posted August 16, 2005 Not to mention this happened in 2000, now 5 years later they are finally suing the park for an "injury". Anything could of happened with-in those 5 years to cause brain damage, even an unnoticed stroke or clot. Blazing Fury doesn't move fast enough to cause whiplash, maybe on the drop if it wasn't expected, but I remember the warning signs in front of the ride and just like Fire In The Hole .. it's cleary marked that it's an indoor ride with unexpected turns and sudden drops. This is what ruins the country.

coaster1 Posted August 16, 2005 Posted August 16, 2005 It's like the Holiday World lawsuit, they wait until the limitation on the incident is almost up, then file charges. It's just a way to try to get rich quick scheme .. like the Holiday World accident. If they were so concered the ride was unsafe as in that incident and this one, why didn't they file charges ASAP? I mean if you think a ride is so "unsafe" and want it to be corrected or removed, don't wait .. file then.

The 2nd picture is from Fire in the Hole (identical ride from SDC) with the warnings.

When she got off, she said that she was going to sue because it went to fast and gave her a headache. The carnie was like OK and she left. Me and my cousin followed her and she got a refund on her Wrist band. I hate how people complain about rides when the signs are right there --->. It just makes me mad.

gisco Posted August 16, 2005 Posted August 16, 2005 Sounds to me like this guy had a medical problem. The doctors probably told him that they don't know what caused it and things just happen. He decides to do what most people do, blame someone else. In steps a lawyer and tells him it must be the ride at Dollywood knowing that theme parks and coaster safety are a hot topic today. This suit wasn't filed 5 years ago because it wasn't a hot topic then. He really should be filing suit against the state or city that he is from because they failed to teach him in school how to read warning signs. This is a failure in the education system. I wonder what kind of proof he has that he actually rode the ride or he was even at the park?

pianojohn Posted August 17, 2005 Posted August 17, 2005 How about this: if you come to a ride you aren't sure about, and you have read all of the warnings and signs, DON'T RIDE IT! Geez!! Remember all those cool one-of-a-kind signs at Cedar Point for each ride? They were all replaced by boring, VERY wordy signs which lists all of the safety requirements and warnings.

I've been riding Vekoma rides for years and I have no brain damage. 2+2 =...um....er....what's a "2?" Six Flags got around that by calling their SLC's "Mind Eraser". In fact, I think someone did file a lawsuit several years back claiming she had memory loss from riding it.
