Sutterlin, officials reach sales agreement By Jane Smith 03/16/07 — CONNEAUT LAKE — An agreement has been reached to sell 3.3 acres of land at Conneaut Lake Park to Greg Sutterlin of Conneaut Lake for $1.7 million. However, it’s is contingent upon several factors: n Summit Township supervisors must amend a zoning ordinance to allow 10 units of condominiums be erected on the site, which includes the former Flynn House property and adjacent property. n Court approval and that no appeals are filed. n CLP officials must undertake all necessary steps to open the park for the 2007 season. If Sutterlin determines that isn’t happening, he can declare the agreement null and void. n The gate-guard booth on Reed Avenue at the entrance to the park must be removed. The agreement allows Sutterlin to construct three or more separate condominium buildings within the complex. Two will be located parallel to Conneaut Lake and the third will be positioned on the west side of Lake Street. It prohibits the park from selling any other lakefront or lakeview land within the park for five years following completion of the sale. It also prohibits the park from creating or constructing its own residential development on its lakefront or lakeview property. However, that doesn’t apply to or affect any use or potential use, renovations, remodeling or occupancy of Hotel Conneaut to perpetuate its use as a hotel and restaurant, but not as a condominium or other residential development. The agreement also includes the sale of the docks around the property as of Oct. 31, 2007. All dock fees and rental income for this year should be split between the park and Sutterlin with any adjustments after the closing. The contract calls for a non-refundable downpayment of $5,000 and the remainder to be paid in cash upon completion of the sale. The next step now is to petition Crawford County Court of Common Pleas for a hearing to approve the sale. LeRoy Stearns, court-appointed overseer, has said he will use a portion of the sale proceeds to open the park this season. He plans to use a majority of the money to pay off the estimated $2.3 million or more debt, including all real estate taxes on all properties owned by the park as well as bank loans. The 115-year old amusement came under court jurisdiction after a lawsuit was filed by former Trustee member Dana Watson in 1998 against the remaining board members over a dispute about a contract with former owner-operator Gary Harris. As a result of that suit, the park was declared a public trust. Stearns was appointed overseer when the former overseer, Herb Brill, resigned. Following that, the rest of the board resigned in September of 2005 after hiring George Deshner as general manger. Stearns remains as court-appointed overseer, whose job is to stabilize the park and protect the trust. It'll make a dent at least.

Roller Coaster Tycoon lawsuit goes to UK High Court Mark Raby March 13, 2007 10:17 London (England) - Chris Sawyer, the developer of the PC hit series Roller Coaster Tycoon, has sued the game's publisher Atari, alleging that it skimped out on paying royalties and other fees totaling millions of dollars. Though it sounds like an easy court decision, Atari's counter-claim has stalled the process. Atari's claims open up new legal questions in the UK that have pushed the case to the House of Lords, which is essentially the UK version of the US Supreme Court. In total, says Sawyer, Atari owes him $4.8 million because he was underpaid between 1999 and 2001. He alleges that for those three years, Atari would not allow him or third-party auditors to access its accounts. Atari's defense is that Sawyer commissioned development company Frontier to create a game demo for Roller Coast Tycoon, which induced copyright infringement and severed any responsibility for Atari to pay Sawyer. The "law of inducement" is different in the UK than it is in the US, and because of the precedents Atari would legally have little chance at success. However, the House of Lords has the power to change the law, which could give Sawyer a victory.

  20. Wow, given that info I'm surprised Disney doesn't have a ton of parks there. They're always getting sued for something. I'll have to upload my my photochop from a while ago. I did Six Flags over Baghdad.
