  2. That's not necessarily true. It is going to depend on the type of lawsuit to see if it can be dismissed. I'm not sure how a breach of contract would work in this situation, but my guess is that it would be related to if the breach was willful or not. I do know that in a tort action negligence can be dismissed in bankruptcy proceedings, whereas intentional torts cannot. This means that if the whole thing about rides being sold that were not the property of Six Flags, and the city sued for conversion, because that is an intentional tort it can't be dismissed.
  3. If I take codeine products I have had some history of sleepwalking. So now I will simply tell Dr.'s that I'm allergic to it.
  4. I want to know what exactly they are suing for. It sounds to me like they're look at a suit for breach of contract, but I'm not really sure. The article doesn't say anything about who owns the rides or if Six Flags stole the rides (stole is the wrong word, the technical term here would be conversion). I'm thinking that the lease agreement may have included a clause in it that required Six Flags to actually operate the park (something saying that they couldn't simply hold the park but keep it closed). If that were the case they could sue for breach on that. If that's the case the most likely outcome is that Six Flags is going to have to pay a certain amount to New Orleans for the breach and the lease may become voided. There always is the option of specific performance (where the court basically demands the park reopen) however that if very unlikely. That is my best guess at this, but without more information it's going to be difficult to figure out what is going on.
  5. While all this talk about handrails and the general nature of crime and punishment is great, I was actually wondering how the rest of the park was doing. Are a lot of rides still in their yearly rehab, or have those come to an end yet?

  7. I wonder if the time will come where they simply try and sell the ride to another buyer. The spent $100,000 on it, which is a lot to spend for a park like that if they just plan to let it rust in the parking lot.
  8. Personally I don't think we'll ever see the ride up and running again. Joyland has been dragging their feet on a ride that should have been up and running for a while now.
  9. I'm taking a cruise out of Galveston, TX in a few weeks. While down there I'll grab my Kemah credits, but nothing other then that is currently planned.
  10. The more I think about it (and I will admit I don't really know the underlying economic factors at play) I really think the way to go right now would be a charge per ride system. Have the park cost $10 to get inside, and then have an additional charge per ride. Maybe sell a wrist band for unlimited rides for $30 (all these prices can be played with, they're just examples I'm throwing out there). Maybe if they did that they could get people in the gate to at least see the park. In 5 years or so if they've got a base group of visitors, then transition over to an all inclusive admission and ride price. Best thing to do now is just sit back and wait to see if the park does offer some really good deals to try to get people in there. More then anything right now they need to focus on getting people through the front door at all necessary costs. This park is going to really have to work double time now to prove itself or it has no hope.
  11. Well I've got a report on this ride, sort of. I caught about 3/4th's of a story about it, and can't seem to find anymore information online. Basically nothing has changed. Joyland is still having problems with the soil being unstable due to recent rains. Not sure what rain they're talking about, we really only had a single significant storm in terms of accumulation last year (though it did produce 11 inches of rain in a single day). The report said that the park is saying that they hope to have the coaster open and running for the start of the 2010 season. So not much of an update I guess, just confirming everything we know and dragging it out one more year. I may have missed some more important information in the part of the report I missed, but I doubt it. I'm only going to be in Lubbock for 1 more year, so I'm hoping this thing opens next year (though not counting on).

  13. I miss the guns on the log ride, always was fun trying to hit the targets on the drop! What was the last time anybody saw the guns actually working, I'd be willing to say that we're talking years.
  14. I got a bread machine as a wedding gift and was a bit puzzled about when I would ever use it. After discovering how good home made bread is however that thing does get a good amount of use!
  15. Certain groups of employees are unionized, but by and large they are not.
  16. I'm a Kings fan. Back in 1994 I was a little kid just starting to get into sports. I have to make the choice if I want to be a King fan or a Duck fan. The Kings were coming off a trip to the finals, the Ducks sucked. Just glad all these years later that the Kings have had such continued success.

  19. ^ Do most people on here follow both an AL and an NL club. I always have and have always wondered if most others did. I personally am a Dodger/Red Sox fan. However my loyalties are much more with the Dodgers, in fact I think the only real reason I like the Red Sox is because I dislike the Yankees so much. I will also admit that I started following the Sox during their World Series win. So yeah I guess I'm a bandwagon fan in that regard. But it's ok, if I root for two teams I figure I can be a bandwagon fan for one of them.
  20. One of the problems is that several years ago a lot of people (myself included in this) started websites when we were somewhat young. I liked coasters, why not have a website about them? Easy as that. So the web got flooded with websites on theme parks by a bunch of young teenagers. As time went on a lot of us grew up and things changed. My site for example was done in because of school. I closed it down right around the time I started college because I couldn't manage both the site and my grades. It was too much for me. I'm guessing a lot of the other sites that used to be big and now are gone fell to similar fates.
  21. ^The problems with the Cubs ever winning is that once they do are there really any great droughts left in Baseball? If the Cubs win the series, that means that the three longest droughts would have all come to an end. After the Cubs who is suffering the longest World Series drought? I'm thinking maybe the Indians? The Giants have also (which in my opinion is a great thing, GO DODGERS ) been waiting a very long time.
  22. Ah Eric I stand corrected! I completely forgot about the onboard sound. Those can be tricky to get to work right so yeah I'm sure that is going to take some more time. But I agree with what has been said, the people that build these rides know how to do it better then any of us do. I'm sure they have a calender telling them where they have to be at any given point in order to get the ride open in time.
  23. I actually remember that Nova episode! In terms of testing, it is going to really depend on the type of ride. Rides that are doing something new and innovative take a longer time to test. Terminator doesn't really do anything innovative (not that I'm saying there is anything wrong with that) so I would be willing to guess that testing for it will be pretty quick.
  24. ^I used to come to this site for the neon coaster! Not sure if Robb would agree, but I think to an extent what must have helped this site is simply longevity. There have been photo trip reports on this site for a long time now. I know a lot of people who used to post on RRC would come to this site for those reports, so over the years as RRC started to decline in popularity this was a logical place for people to come. Robb was a long time poster on RRC, everybody knew him there and (for the most part) liked the trip reports, so might as well join these boards. What that did though was give these boards a little bit more credibility, people knew the contributors to these boards from other places, and thus stuck around here. Why do I post at TPR? When I was younger I was a member of basically every coaster site out there (Goose's site, Danimation, Westcoaster, American Coaster Network, my site, RRC, and URC were just some places where I was a regular, I posted at several others but not as a regular). I kind of fell out of the hobby for a couple of years, and when I decided that I missed aspects of it, I decided that I would join a single community. I joined here because I knew a lot of the names from the various places I posted, and I figured that while a lot of people wouldn't remember me, a handful would, and I wouldn't be a complete stranger when I started posting again. The point of all this is that a big part of growing a community like this is having a strong core of people who are contributing. My sites forums never worked because while I had a lot of people posting, I had very few regulars. I had people who'd come post 1 question and that would be the end of it. TPR I think has grown in large part because they have established a great group of core members. Just my 2 cents.
