Hey guys

 

Just wondering if anybody has come across this and has any advice.

I shot a video of the Rock N Rollercoaster Launch with the lights on in Paris. I've posted the video on Youtube and becasue its had so many hits they've offered me to join their Partnership Programme to make money off the video. But you have to be the content owner and have full rights and it cant be copyright and all that stuff.

 

Now the question is I shot the video so do I own the rights to it or is it copyright or anything like that. There is no one in the video. Any comments would be appriciated.

Although I'm not a lawyer (nor do I have any intention of becoming one), from what I know about copyright, you might have some trouble.

 

Being in France creates a huge problem for copyright, as there is no Freedom of Panorama (see Wikipedia article. This means that pictures (and likely video) of buildings (interior and exterior) and any kind of artwork displayed is owned by the architect/artist who created the original work. Even if you mute the music, video of the interior of the ride building and the ride theming would probably be a derivative work and Disney (or whoever designed the ride) would still own the copyright.

 

On the other hand, there are provisions like De minimis. Do have a link to the video?

I'm in a similar predicament. I have a RCT3 recreation of the DL Haunted Mansion on my Youtube account. This video alone accounts for nearly half of my channels view count. I could try to apply for the Partnership program, but I don't own the rights to the Haunted Mansion's ride soundtrack which plays in the background along with the video. It's also in game footage from RCT3 which might also be another variable that might not fly well.

 

I thought about it for a long time and decided to not apply. If you apply for the program and are rejected there is a good chance that your video will be deleted. Now in my case, with a majority of the traffic coming to my channel through that video I can't really afford to have it be deleted. I think if I have any advice it would be "Better safe than sorry".

Thanks for the thoughts guys.

My dads friend who used to work as a photographer for our countries national paper said i shouldnt have any problem as I shot the video I have the user rights and as there is no people/music/logos in the video it should be perfectly fine for copyright law.

I really think you should probably do some research as to what your rights are as the "videographer" and what copyrights Disney holds as the "intellectual property owner of the attraction."

 

I think your video is fine as it is when you are NOT making money off it, but the moment a stream of revenue comes in, no matter how small the amount may be, based on someone elses intellectual property you might need to get permission from Disney.

 

For example, every coaster we have on our "Roller Coasters in the RAW" DVDs we have to get the approval from the park even if we've shot it ourselves.

 

If it was video from an attraction at just about any other park, I'd say you probably could risk it, but this being Disney who have more lawyers than most companies have total employees, I'd be a little more cautious.
