Disneyland Employee Pleads Not Guilty to Dry Ice Explosions

ANAHEIM, Calif. (KTLA) — A Disneyland employee accused of setting off two dry ice explosions at the theme park pleaded not guilty on Thursday.

Christian Barnes, 22, of Long Beach, was charged with a felony count of possession of a destructive device in a public place.

Barnes was originally reported to have set off one bomb, but authorities revealed on Thursday that he allegedly had two water bottles containing dry ice.

The first bottle exploded in his vending cart, and a second bottle tossed into a trash can went off several minutes later, prosecutors said.

Barnes’ bail was set at $500,000, down from $1 million.

His next court appearance was set for June 7. He could face six years in prison if convicted.

The explosion in the trash can was reported around 5:30 p.m. on Tuesday in Disneyland’s Toontown area.

There were no injuries and no damage reported, but it caused quite a commotion.

Parkgoers were evacuated from the area immediately, and the Orange County Sheriff’s Department Bomb Squad was called in to investigate.

“We’re not certain that he understood the full weight of what would happen when this did go off in those trash cans,” Anaheim police Sgt. Bob Dunn said.

“Is it possible that it was a prank? Absolutely,” Dunn said. “Are we investigating it as a crime? Absolutely.”

Barnes’ father, Raymond, told KTLA that he thought the whole thing was just “an unfortunate mistake.”

“He’s not someone that would do something to hurt anyone or anything like that,” he said. “He’s not violent at all.”

“They have a right to check into things thoroughly, and I understand that,” he said. “But when the smoke clears, they’ll see that he’s a very good kid.”

Disneyland officials said they were taking the matter very seriously and were working with authorities.

  2. I am a little rusty on law and not that familiar with California law. However, I think if he uses a "bondsman" then this can be reduced to 10%. Still, that is $100K that needs to be dug up and maybe if he has family that owns their house they can put a loan against it if worth over $100K. For the life of me, I can not remember the % though on what the bondsman keeps after showing up for a hearing. I however believe it is a large a %.

At any rate, this numb nuts just caused himself and his family a world of problems for being stupid.

  3. I am hoping that the neglect on the ride is part of the plan of a larger make over in the next few years.

I believe they had a solid theme with the last makeover with the Archeological aspect. From my faded memory, the elevator was supposed to to be the way to get to the lost / found Ark. Once the elevator failed you would land in the section that has the skeletons that you walk over. I think this was supposed to represent archeologists that also died trying to find the ark. After that it is pretty much the original Ark theme through the boat until the high seas room. I believe this was supposed to represent turbulence conditions within the Ark dig site. Then would have been the room that has nothing now (cut from budget) this room was supposed to have scaffolding that was moving like it was in an earthquake. You would then enter into the flood chamber that would start flooding and escape the dig site.

I am not sure if I would like to see them finish this concept or bring back the whale entrance and the hippo scene with the bridge.

Please, do not even get me started on what happened to the Old Mill...

  4. There was a discussion awhile back on kpconnection in regards to the flooding chamber being down. I do not remember it word for word. However, I believe it being down has something to do with the accessibility of the equipment that runs the chamber. If I remember correctly they would have to tear out large portion a back wall or the actual chamber itself to replace parts. Thus, they may be just waiting for a a complete overhaul of the ride. I am personally hoping they overhaul the whole Ark again. When they cut many of the scenes due to budget of needing to rebuild the whole boat, the ride just did not flow properly in my opinion with the intended theme. The intended story would have been a good one.

  5. Kinzel stepping down from Cedar Fair board

About 10 years ago, Cedar Fair implemented a mandatory retirement age of 72 for board members.

“I think it’s a good thing, brings in new blood,” Kinzel said after Wednesday’s announcement. “I had 40 years with the company. Cedar Fair is a great company and they took care of me.”

Cedar Fair CEO and president Matt Ouimet can now build his own team, just as Kinzel did when he was CEO. This would include board members who can provide advice and guidance to Ouimet.

Kinzel resigned from his leadership post at Cedar Fair in January 2012. He and his wife, Judy, have been traveling and spending more time with their children and nine grandchildren. They plan to remain in Sandusky, but they also have a winter home in Florida.

“This is our home,” Kinzel said of Sandusky.

John Hildebrandt, general manager of Cedar Point, worked with Kinzel for 37 years.

“Dick built Cedar Point into Cedar Fair, a billion-dollar entertainment company,” Hildebrandt said. “He more than made his mark.”

Hildebrandt said when he thinks of his colleague, he thinks of a devoted family man and a risk-taker. He also thinks of the Magnum XL-200, Cedar Point’s steel coaster built in 1989. Under Kinzel’s direction, Magnum was the first coaster to exceed 200 feet. The ride is often credited with starting the coaster wars among amusement parks forever seeking to claim ownership of the tallest and fastest coasters.

During an earnings conference call Wednesday, Ouimet thanked Kinzel for his years of service.

“For more than three decades, Cedar Fair has benefited from Dick Kinzel’s experience,” Ouimet said. “I am certain he will sustain a keen interest in our performance going forward.”

Replacing Kinzel on the board will be Scott Olivet, CEO of Renegade Brands LLC, a California-based investment company. He’s executive chairman of RED Digital Cinema, and he sat on the board of Collective Brands as well. He was also a partner with Bain & Company, a strategic consulting firm, and he was CEO and director of Oakley.

  6. Cedar Fair exec (Falfas) should get his job back, court rules

    By RICHARD PAYERCHIN

    rpayerchin@MorningJournal.com

SANDUSKY — A longtime executive could return to his job running operations for the parent company of Cedar Point amusement park, according a court ruling.

In June 2010 Cedar Fair Entertainment Co. announced the resignation of Jacob T. “Jack” Falfas, the chief operating officer who had worked for the company for 39 years.

But Falfas challenged the end of his employment with Cedar Fair and this month a court ruled he should be reinstated to the job. The decision came out of the 6th District Court of Appeals in Toledo.

“The court of appeals said that Jack Falfas is ordered reinstated to his job as chief operational officer of Cedar Fair,” said his attorney, Richard Panza of Avon.

About June 10, 2010, Falfas had a brief telephone conversation with Cedar Fair Chief Executive Officer Richard Kinzel, according to court records.

“The parties had differing interpretations of the effect of the telephone conversation, with (Cedar Fair) claiming (Falfas) resigned and (Falfas) claiming he was terminated,” the appeals court ruling said.

Falfas sought a ruling through an arbitrator, pursuant to his contract with Cedar Fair. In February 2011 an arbitration panel ruled he “was terminated for reasons other than cause” and “the facts fail to establish resignation,” according to the appeals court decision.

The panel ordered he should be reinstated with back pay and benefits.

Cedar Fair officials appealed that decision by filing a case in Erie County Common Pleas Court. There a judge ruled Cedar Fair owed back pay and benefits to Falfas, but that the law did not permit Falfas to be reinstated, Panza said.

Falfas appealed that ruling to the 6th District Appeals Court in Toledo, where Judges Arlene Singer, Thomas J. Osowik and Stephen A. Yarbruogh ruled Falfas was entitled to back pay, benefits and reinstatement, Panza said.

The appeals court sent the decision back to Erie County Common Pleas Court for further proceedings.

Falfas would like to return to work and he will not appeal the decision further, Panza said. However, Cedar Fair Entertainment Co. could ask the Ohio Supreme Court to consider the ruling, he said.

“If in fact he is permitted, if Cedar Fair will honor the decision of the 6th District Court of Appeals, then he is ready, willing and able to return to work,” Panza said.

Kinzel, who retired as Cedar Fair’s CEO, remains on the board of directors of the amusement park company, according to cedarfair.com.

“We’re certainly reviewing that ruling to determine what the appropriate next steps will be,” said Stacy Frole, Cedar Fair’s corporate vice president for investor relations.

Judge Roger E. Binette ruled on the case in Erie County Common Pleas Court. He said his ruling was based on Ohio law, legal precedents and the language of Falfas’ contract.

“The court of appeals interpreted the law differently than I did and I’m willing to follow the law as directed by a higher court,” Binette said. If the case goes to the Supreme Court and there is another ruling, Binette said he would abide by that decision as well.

  7. I am originally from Pittsburgh and just got back this week for work and picked up Primanti Bros sandwich. It is pastrami (double meat), three eggs, sour slaw and fries. Yep, a heart attack on bread, but this is the first one I had in 3 years... Last night I had Quaker Steak and Lube wings.

Anyways, yes Peppis is also great for a steak sandwich (I always got the phantom).

For breakfast I would recommend Pamela's or Delucas in the strip. Avoid Jo Jo's if you can since that is so greasy that it makes Waffle House look like gourmet. Jo Jo's is only good for a late night bite after a full night of drinking to help clean out your internal system.

And for the record, yes there are many fat people in Pittsburgh. I was never one of them since I am skinny even though I eat all this bad food...

  8. Thanks AJ for the information... Yes that is a bummer. It is good though to see that the park owners are maintaining a smart sense of financials and not getting in over their heads. There are so many companies out there (including the one I work for) that try to expand to fast and then all of a sudden see themselves in a debt situation they cannot handle. They did so much this year with buying the Inn, demolishing the cottages, refurb of the Ferris Wheel and Scrambler, addition of the Musik Express with landscaping and re-track work of RV2. I am sure all added up that is a large amount of $.

  9. Got to love this quote.

"We are not allowed off of the boat despite the fact that we have no way to use the restrooms on board," Jonathan Evans of Reidsville, N.C., said in an email early Thursday. "The cruise director is giving passengers very limited information and tons of empty promises. What was supposed to take an hour has turned into seven-plus hours."

  10. Kim McKerreghan stood clutching an "I love my cruise" bag in one hand and her 10-year-old daughter Allie Taylor in the other.

Allie had sailed on the cruise, her second, with her father and some friends.

"It got super duper scary" after the engine fire, she said, standing in the parking lot in flip flops. "I said ‘Daddy, what’s going on?’ and he said ‘I don’t know.'"

Later, Allie said she ended up being the stabilizing influence -- when her father ran out of METH.

"I tried to calm him down," she said.

Ladies and gentlemen, your Karnival clientele at its finest.

    Fixed.

  11. If it is the case you can not blame Cedar Fair. I have always thought that they did buy the park to kill competition. Six Flags overgrew it and launched a marketing campaign against Cedar Point that they could not hold. You know, that is business and I see companies acquired all the time. It happens...

I however, felt that they wanted to initially keep it in an Idlewild \ Kennywood fashion and it just did not work out.

Kennywood bought Idlewild years back and marketed the two parks properly. I really believe they wanted to reduce the park to a family friendly waterpark and amusement park like Idlewild. Which is really what it was prior to SF buying it.

From what I understand. The same people bitching about the current state are the same that where bitching about it being there in the first place. Bet they wished they did not initially go to Aurora County and Baimbidge County (however they spell it) to give a hard time about the park while it was operating. I am proud that the problem these idiots had are getting the big middle finger from Cedar Fair now.
